1.EB-1A Talent Program

EB-1A is the first priority occupation-based immigration category A in the United States. Its full name is Employment-based Immigration: First Preference. (Category A), that is, Alien of Extraordinary Ability. It is mainly open to foreign applicants who have outstanding abilities and achieved certain achievements in science, business, education, art or sports. EB-1A does not require a labor certification and does not require a permanent job commitment. The applicant obtains a US green card in one step, and his or her spouse and children under the age of 21 can accompany them.

Application Requirements

A well-known internationally recognized award or meeting 3 of the 10 criteria for applicants under US immigration law

1. Major internationally renowned awards:

• Nobel Prize, Olympic medals, Oscars, Grammy Awards, Emmy Awards, etc.
• The applicant only needs to prove that he/she has received more than one major internationally renowned award. Based on this award alone, without providing other evidence, he/she can meet the standards of outstanding talent and immigrate to the United States.

2.NIW Talent Program

• EB-2 NIW (National Interest Waiver) National Interest Waiver Immigration It is a special case of the EB-2 category. Unlike ordinary employer-supported immigrants (EB-2 PERM), applicants do not need employer sponsorship. As long as they prove that they can bring benefits to the United States by relying on their abilities, they can obtain a permanent green card.

Application requirements

• Possess “advanced degree” or “special skills”

• 1. “Special skills” "Skills" refers to meeting at least 3 of the 6 criteria:
• Recommendation letter with ten years of work experience in the professional field
• Professional skills recognized by peers , cited
• Obtain academic certificates in professional fields

• Members of associations 

• 2. "Advanced degree" means meeting any of the following:

• Possess a bachelor's degree and more than 5 years of work experience in related professional fields.

EB-1A&NIW application process

• Prepare materials. After signing the contract, U.S. lawyers and immigration consultants will guide the applicant to prepare materials;
• Submit the application. Submit a complete set of application documents and I-140 application form to the USCIS;
• The application is approved. I-140 application is approved by USCIS;
• Visa preparation. The file is transferred to the U.S. National Visa Center NVC to start visa preparation;
• The person is in China. If the guest has lived in China for a long time, he or she will go to the Guangzhou Consulate for an interview and wait for the result;
• The person is in the United States. If the guest has lived in the United States for a long time, submit the I-485 form to change the identity and wait for approval;
